Welcome to the www.BuzzTelecom.ca User Agreement. Your use of this site, which comprises all information, content and services under the www.buzztelecom.ca domain, is subject to the Terms and Conditions expressed below. You accept that you have read, understood, and agree to be bound by all terms and conditions of this agreement, as well as any further rules or policies that are or may be published by BuzzTelecom.ca from time to time. Applicable Terms and Conditions: Rates, conditions and minutes advertised are subject to change without notice and vary between cell phones, landlines, and PC to phone. A disconnection may occur due to the quality of certain cellular or telephone networks beyond our control. 1. Buzz Telecom does not represent or guarantee that its products or services will be uninterrupted at any time, or free of errors. Buzz Telecom will not be liable to the Purchaser for any damages/losses in whatever manner caused, including resulting losses and damages. Buzz Telecom’s liability shall be explicitly limited to a reimbursement of the unused product or services. Buzz Telecom will not be held accountable for any losses/damages as a consequence of shifting calling card rates due to service provider changes. 2. This agreement comprises the full agreement between the user and Buzz Telecom with respect to the products or services if not otherwise stipulated herein. It reinstates all preceding or concurrent proposals and communications whether electronic, written or oral, between the user and Buzz Telecom. 3. The products or services that are offered by Buzz Telecom are for personal use only. Any unlawful commercial use of the products or services, or the resale of the products or services is clearly prohibited. The Purchaser will not use Buzz Telecom products or services for any purpose that is illegal or outlawed by these Terms and Conditions. The Purchaser is exclusively responsible for all acts or exclusions that come about under your account or password, including the content of your transmissions through the used products or services. The Purchaser also agrees to accept all valid local, provincial, federal, state, national and international laws and regulations. 4. Changes are occasionally made to Buzz Telecom products or services, these Terms and Conditions or the products and services themselves. The information and services included in or offered through the products or services provided may include typographical errors or inaccurateness. The Purchaser consents to be obliged to such changes to the herein information. 5. Buzz Telecom at any time reserves the right to modify or change the Terms and Conditions or policies concerning the use of the products or services and to notify you by posting an updated version of the Terms and Conditions on this web site. The revised Terms and Conditions shall be effectual instantly upon posting. 6. If Buzz Telecom with discretion decides to terminate your access to any part or all of the products or services and any related service(s) at any time for any reason, Buzz Telecom's entire and complete liability to the Purchaser will be to reimburse the unused price of the products or services less any claim for set-off Buzz Telecom may have in opposition to the Purchase. 7. You may not duplicate, amend, republish, upload, copy, post, transmit, or distribute in any way content presented through Buzz Telecom products or services. The Purchaser recognizes that content, including but not confined to text, music, software, sound, photographs, graphics, video or other material electronically allocated or contained in sponsor advertisements or commercially generated information concerning the products or services is defended by trademarks, copyrights, patents, service marks, or other proprietary rights and laws. 8. You agree that no affiliation, joint venture, agency relationship or employment is existent between you and Buzz Telecom as a consequence of the use of our products or services or this agreement. 10. Any and all claims for losses or damages must be brought in the Province of Quebec and in no other jurisdiction. This agreement is governed by the laws of the Province of Quebec and Canada. 11. Acceptable in administrative or judicial proceedings shall be a printed and revised version of this agreement with reference to, or based upon this agreement to the same extent and contingent on the same provisions as other business records and documents formerly produced and sustained in printed form. 12.This website and the products and services offered by Buzz Telecom, are offered "AS IS" devoid of any kind of warranty, either conveyed or implied, comprising but not limited to merchantability or warranties, non-infringement or suitability for a specific function. 13. You are in agreement with Buzz Telecom that any cause of action stemming out of, or associated to the products or services must initiate within six (6) months after the cause of action occurred or be forever barred. 14. You agree that you shall endorse and defend Buzz Telecom and its affiliates, directors, employees and officers against all liability, claims, damages, costs, and expenses, including equitable legal fees, stemming from or associated to your breach of these Terms and Conditions. 15.
